Terms of service
Welcome to gemsby.em. These Terms of Service explain the terms that apply when you browse our website, place an order or purchase from us.
By using this website or placing an order, you agree to these terms. Please read them carefully before purchasing.
Nothing in these terms affects your statutory rights.
1. About us
This website is operated by gemsby.em.
Business name: gemsby.em
Email: gemsby.em@outlook.com
Website: gemsby-e.myshopify.com
In these terms, “we”, “us” and “our” refer to gemsby.em. “You” and “your” refer to the customer or website user.
Shopify provides the ecommerce platform that allows us to display products, operate our online shop and process orders through our website. However, when you purchase from this website, your contract is with gemsby.em.
2. Our products
gemsby.em creates handmade jewellery, including necklaces, bracelets, earrings and accessories.
Our pieces are made using carefully selected materials. Because each piece is handmade, slight variations in colour, bead shape, gemstone markings, size, finish and arrangement may occur. These details are part of the character of handmade jewellery and do not make the item faulty.
We make every effort to display our products accurately. However, colours may appear slightly different depending on your device, screen settings and lighting.
Product descriptions, pricing and availability may be updated at any time.
3. Materials and care
gemsby.em jewellery will always state the materials used.
To keep your jewellery looking its best, please avoid regular contact with water, perfume, lotions, fake tan, sweat, chlorine and harsh chemicals. We recommend storing your jewellery in its box or pouch when not being worn.
Care information is provided on our website. Damage caused by improper use, poor storage, accidents or failure to follow care guidance may not be treated as a fault.
4. Prices
All prices are shown in GBP (£).
Delivery costs are not included in product prices unless clearly stated. Delivery costs will be shown at checkout before you place your order.
We may update product prices at any time, but this will not affect orders that have already been accepted.
If a product has been listed with an obvious pricing error, we reserve the right to cancel the order and refund you.
5. Payment
Payment must be made in full at the time of placing your order.
Our checkout is powered by Shopify. We accept the payment methods shown at checkout.
Payments are processed securely by Shopify and/or the relevant third-party payment provider. We do not store your full card details.
By placing an order, you confirm that the payment details you provide are accurate and that you are authorised to use the chosen payment method.
If your payment is declined, your order will not be processed.
6. Placing an order
When you place an order through our Shopify checkout, you are making an offer to buy the item or items in your basket.
After placing an order, you should receive an order confirmation email. This confirms that we have received your order.
An order is accepted once we send your order confirmation and/or begin processing your order.
We reserve the right to refuse or cancel an order where reasonably necessary, including if:
- the item is unavailable;
- there has been an error in the price or product description;
- payment cannot be processed;
- we suspect fraudulent activity;
- we are unable to deliver to your address;
- the order includes a product we are unable to make or supply.
If we cancel an order after payment has been taken, we will refund you using the original payment method.
8. Delivery
We currently deliver within the United Kingdom, and a select few international countries only.
If your country is unavailable please contact gemsby.em@outlook.com to discuss.
Delivery options, costs and estimated timeframes will be shown at checkout and/or in our Shipping Policy.
All import duties and taxes are the responsibility of the buyer.
Please ensure your delivery address is correct before placing your order. We cannot be responsible for delays or failed deliveries caused by incorrect delivery details provided by you.
Once your order has been dispatched, delivery times are estimates and may be affected by postal delays, bank holidays, busy periods, weather disruption or other circumstances outside our control.
9. Returns and cancellations
Please see our Returns Policy for full details.
For most online orders, UK customers usually have the right to cancel within 14 days of receiving the item, followed by a further 14 days to return the item after notifying the seller.
Returned items must be:
- unworn;
- unused;
- in their original packaging;
- in a resaleable condition.
Customers are responsible for return postage costs unless the item is faulty, damaged or incorrect. Refunds will be processed to your original payment method once the returned item has been received and inspected, in line with your statutory rights.
10. Non-returnable items
Some items may not be eligible for return unless they are faulty, damaged or incorrect.
This may include:
- earrings, for hygiene reasons, where they have been opened or worn;
- personalised, bespoke or custom-made pieces;
- items that have been worn, used, altered or damaged after delivery.
This does not affect your statutory rights.
11. Faulty, damaged or incorrect items
Every gemsby.em piece is checked carefully before dispatch.
If your order arrives faulty, damaged or incorrect, please contact us as soon as possible at gemsby.em@outlook.com.
Please include:
- your name;
- your order number;
- a description of the issue;
- clear photos of the item and packaging.
If your item is faulty, damaged or incorrect, we will offer an appropriate solution, which may include a repair, replacement or refund.
Normal wear and tear, accidental damage, damage caused by improper use or failure to follow care guidance will not usually be treated as a fault.
12. Custom orders
Custom or bespoke orders are available through request followed by an invoice.
Custom orders are made specifically for you and they will not be eligible for cancellation or return unless they are faulty, damaged or incorrect.
Any custom order details, including sizing, materials, price and estimated dispatch time, will be agreed before the order is confirmed.
13. Sizing
Product sizes will be listed on the relevant product page where applicable.
Please check sizing carefully before placing your order. If you are unsure about sizing, please contact us before purchasing.
Where a piece includes an extender chain or adjustable element, this will be stated in the product description.
14. Promotions and discount codes
We may offer promotions, discount codes or limited-time offers from time to time.
Discount codes must be entered at checkout and cannot be applied retrospectively.
Promotions may be subject to separate terms and may be changed or withdrawn at any time, but this will not affect orders that have already been accepted.

- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation;
- faulty goods where liability cannot legally be excluded;
- any other liability that cannot be excluded under UK law.
We are not responsible for losses that were not reasonably foreseeable when you placed your order, or for business losses where products are purchased for personal use.
20. Events outside our control
We are not responsible for delays or failures caused by events outside our reasonable control.
This may include postal delays, strikes, severe weather, supply issues, technical problems, power failures, internet disruption or other events beyond our control.
